By using this website and any freelance service offered at this platform, you agree and understand that any information provided to you by any MysticsFive.com seller is intended for general entertainment, religious or informational purposes only and that any service, consultation or ritual work with any MysticsFive.com seller, or any information provided by any MysticsFive.com website advisors, readers, casters, practitioners, or any seller is not in any way a substitute for the advice and counsel of a qualified professional.

You understand  and agree that MysticsFive is not responsible for and does not screen sellers, nor verify the name, identity, or location of any seller or user and that MysticsFive does not quality, test, review, endorse, recommend, verify, evaluate, warrant or guarantee any work, any qualifications, profile or biography, cv or resume, expertise, claims or background of any seller or guarantee or recommend any advice, promise, opinion, response, advice, prediction, recommendation, information or other offerings or  service provided by seller.

The following terms and conditions (these “Terms of Service”) shall govern your access to and use of the MysticsFive website, including any content, functionality and services offered on or through www.MysticsFive.com (the “Site”), by MysticsFive.

In order to participate in the Site or the Services as a MysticsFive.com seller or buyer you are obligated to review and accept the MysticsFive Terms of Service.

IMPORTANT: If you do not wish to agree and abide to these Terms of Service or the Privacy Policy, DO NOT access or use the Site.

You must be eighteen (18) or older to use the MysticsFive Site or Services. You understand that the Site and the Services are intended solely for users who are eighteen (18) years of age or older. Any use of or access to the site or the services by anyone under eighteen (18) is unauthorized.

You understand and agree that you may not use the site or the services where such use is prohibited. You represent and warrant that you are eighteen (18) or older and that you agree to and to abide by all of the terms and conditions of this Agreement.

You agree not to use the site or the services for any purpose that is prohibited by this Agreement.

You agree that you are responsible for all of your activity in connection with the MysticsFive.com website.

You agree that you shall abide by all applicable local, state, national and international laws and regulations and, if you represent a business, any advertising, marketing, privacy, or other self-regulatory code(s) applicable to you.

You understand that you are entirely responsible for maintaining the confidentiality of your password and user name and any other security information related to your account.

You understand that YOU ARE fully responsible for all activities that occur under your account, user name and/or password.

You agree not to allow someone other than yourself to use your account, username or password at any time.

YOU AGREE AND ACCEPT that  YOU BEAR SOLE RESPONSIBILITY AND LIABILITY FOR ANY ACTIONS OR OMISSIONS UNDERTAKEN BY YOU IN CONNECTION WITH ANY INFORMATION OR ADVICE PROVIDED BY ANY seller  OR OTHER USERS.

THE ONLY MYSTICSFIVE’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU FOR THE SERVICE of the seller AND USE OF THE SITE, BUT IN NO CASE WILL OUR LIABILITY TO YOU EXCEED $50.

YOU ACKNOWLEDGE and agree THAT IF NO FEES ARE PAID TO US FOR THE SITE AND THE SERVICES, YOU SHALL BE NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM US, REGARDLESS OF THE CAUSE OF ACTION.

You agree to indemnify MysticsFive

You agree to indemnify, defend, and hold harmless MysticsFive, its contractors, licensors, subsidiaries and affiliates and their respective partners, directors, officers, employees and agents from and against ANY AND ALL CLAIMS AND EXPENSES, including ANY AND ALL losses, costs, liabilities, and attorneys’ fees, arising out of or in connection with your use of the site and services and or any user Content, Third Party Content,

Third Party Sites and any other content, and or your violation of this Agreement, or of any law or the rights of any third party, and  or your breach of this Agreement and/or any breach of your representations and warranties set forth herein.

IF YOU DO NOT AGREE TO ALL OF THESE REQUIREMENTS, YOU MUST NOT ACCESS OR USE THE SITE.

Payments

MysticsFive sellers may offer their service starting at  $5. While it is encouraged for Sellers to offer at least one service for $5, sellers are free to offer services of more than $5.

Buyers must pay seller in advance at MysticsFive the amount the seller offers to start an order.

Orders are purchased through the Order button located on a seller’s service offering or through a Custom Offer.

You understand and agree that any and all fees, expenses, and payments for any Transaction shall be arranged directly between you and the seller.

You understand and agree that MysticsFive does not collect, nor store payment and/or credit card information and that ALL payments are facilitated separately by PayPal, or any third party payment or service facility used by MysticsFive.

You understand and agree that any and all credit card, bank, or other payment information supplied by you to pay for any Transaction is transmitted directly to PayPal or any third party payment or service facility used by MysticsFive, which processes, stores, and otherwise uses such information in order to facilitate payment to the seller.

You agree that you will be subject to PayPal’s terms and conditions as well as privacy policy.

You understand that all pricing, rates, and fees for any Transaction are set by the applicable seller, and MysticsFive does not set any such pricing, rates, and fees.

You agree to comply with requirement that at all times all credit card and payment information supplied by you is accurate and correct and kept updated with PayPal or any third party payment or service facility used by MysticsFive and that you are fully authorized to use such credit card and payment information and PayPal account (or account with any third party payment or service facility used by MysticsFive) for purposes of paying for any transaction.

You understand and AGREE that once you make any payment for any and all transactions, you will not attempt to cancel, charge back or otherwise seek a refund on any basis that is unfair, fraudulent, misleading, or untrue.

You understand and AGREE that all payments are final and that MysticsFive offers NO refunds.

Sellers

Sellers are required to complete all orders and may not cancel without cause. Cancelled orders will affect the sellers’ rating, level and status.

Sellers ratings, levels and designations are based on performance. The higher the level earned the more the seller may be granted extra benefits such as ability to add extra services.

ALL BUYERS, SELLERS and USERS must not offer or accept any payments using any method other than the order system and process through MysticsFive.com.

Buyers are deemed to be the owner of and granted all rights for delivered work unless there is prior and written specification made  by the seller at their posted service.

MysticsFive retains the right to use all published delivered works for MysticsFive marketing and promotion purposes.

You agree that MysticsFive is free to use any idea, concept, information or  technique contained in any User Content you send to the Site or MysticsFive for any purposes whatsoever, including, without limitation, developing, producing, marketing and otherwise exploiting products and/or services using such User Content; and without remuneration of any kind.

You agree to  perpetually and irrevocably grant MysticsFive the unconditional right to use and exploit your name, persona and likeness included in any User Content.

You agree to grant to MysticsFive the right to sub-license and authorize others to exercise any of the rights granted to MysticsFive.

You agree and authorize MysticsFive to publish your User Content in a searchable format that may be accessed by users of the Site and the Internet, and you waive any rights of attribution, legal action and/or any “moral” or other rights you may have in any User Content you submit even if such User Content is altered or changed in a manner not agreeable to you.

Sellers post their services at MysticsFive to allow Buyers to purchase their work.

Each order seller successfully completes is credited your seller account in the amount of 80% of the purchase amount.

Cancelled orders or sales (for any reason) will be refunded to the buyer’s account balance.

Sellers earnings become available for withdrawal following a clearance period of 14 days after the order is marked as complete.

Withdrawal of seller earnings must be through PayPal

MysticsFive may temporarily disable a seller’s ability to withdraw earnings to prevent fraudulent or illicit activity as a result of security issues, improper behavior reported by buyers, or using multiple MysticsFive accounts.

Sellers are responsible for paying any direct or indirect taxes, including any GST, VAT or otherwise, which may apply to them depending on residency or location. Sellers represent and warrant that they comply, and will comply at all times, with their obligations under income tax provisions in their jurisdiction. The price shown on seller service offering is inclusive of all such taxes and charges that may apply to the Sellers.

Sellers’ services offered on MysticsFive are considered to be User Generated Content.

Sellers’ services may be removed by MysticsFive for violations to any Terms of Service including (but are not limited to) violations, content, and/or materials:

• Illegal/Fraudulent services
• Copyright or Trademark Infringement, and/or violation of a third party’s terms of service reported through our support team
• Adult or sexual oriented services, Pornographic, Inappropriate/Obscene
• Intentional copies of Sellers’ services
• Spam, Harassment, threats or Violence
• Services that have a misleading description
• Reselling of (regulated) works
• Low quality services

Posted services removed for violations are not eligible to be restored.

Violations may result in the suspension or closing of the seller account.

Posted seller services may NOT include any website URLs email addresses, phone numbers or personal contact information within the description. Seller services containing website urls, or promoting content of any other website or which violates MysticsFive’s Terms of Service, will be removed.

Levels

MysticsFive designates the performance and reputation of Sellers with levels. Sellers who are dedicated to giving excellent customer satisfaction, deliver promptly and maintain high ratings are rewarded with  levels of statuses and the status and benefits earned.

MysticsFive Levels are based on reviews, promptness, activity, and performance.

Sellers who drop in ratings, or are late in delivering, or violate TOS risk losing their seller status and the benefits.

MysticsFive’s liability is limited

MysticsFive nor any of its affiliates, advertisers, promoters or distribution partners shall be responsible for any loss or damage, including personal injury or death, resulting from anyone’s use of the Site or the Services, any content posted on the Site or the Services or transmitted to users, or any interactions between users of the Site or the Services and between users of the Site or the Services and sellers, whether online or offline

You may not offer direct payments to Sellers using payment systems outside of the MysticsFive Order system.. Attempting to go around, bypass or otherwise take any buyer from MysticsFive to any other payment  method, website or business will result in suspension or termination of account.

Taxes

Buyers agree that they are responsible to track their ow income and expenses and comply with all tax requirements applicable to them, including but not limited to any obligation to deduct or withhold taxes.

Orders

Once payment is confirmed, your order will begin.

Sellers must deliver completed work using the Deliver button

An order is marked as complete after the order is marked as Delivered and then rated by the buyer. An order will be automatically marked as complete if not rated and no request for modification was submitted within 3 days after marked as Delivered.

Buyers and Sellers must FIRST always try to resolve conflicts among themselves. If for any reason this fails users can contact MysticsFive’s Customer Support department for assistance.

Handling Orders

The buyer orders a service and then the seller is notified by email and in the Notification area on the sellers account.

Sellers must meet the delivery time they specified when posting their service. If delivered late the  buyer may cancel the order. Orders marked as late and may harm the seller’s rating.

Refunds

MysticsFive does not make or give automatic refunds back to your payment provider. Any refund is refunded to the buyer’s balance as credit which is available to the buyer for future purchases on MysticsFive.

To prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund from their account which is subject to review by our team.

Violations

Users may receive a warning to their account for violations of our Terms of Service or any user misconduct reported to our team. A warning will be sent to the user’s email address and will be displayed for such user on the Site. Warnings may not limit account activity, but can lead to loss of level or becoming permanently disabled based on the violation.

You agree and will not engage in any gambling activities, or the payment or acceptance of payments relating to gambling activities. All such activities are expressly prohibited.

You agree that you will not transmit any information or submission and will not use the site and services to post, store, transmit, offer, or solicit anything that contains or that you know contains links to the following or to locations that in turn contain links to the following: material that we determine to be offensive (including material promotion or glorification of  hate, violence, bigotry, or any entity (past or present) principally dedicated to such causes, or items associated with such an entity); material that is racially or ethnically insensitive, material that is defamatory, harassing or threatening; pornography or any obscene material, and anything depicting children in sexually suggestive situations whether or not depicting actual children, or any material or content that may be harmful to a minor; any virus, worm, Trojan horse, or other harmful or disruptive component; or anything that encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law or regulation or is otherwise inappropriate.

You agree not to use the site and services to post, store, or transmit advertising, promotional material, or solicitations of goods or services, except in areas of the site designated for the purpose.

You agree not to otherwise take any action in violation of MysticsFive’s guidelines and policies.

Authentic MysticsFive Profile

You accept and agree that you may not create a false identity on MysticsFive, misrepresent your identity, join/register with a MysticsFive profile for anyone other than yourself (a real person), or use or attempt to use another user’s account or information; Your profile information, including your description, skills, location, while may be kept anonymous, must be accurate and complete and may not be misleading, illegal, offensive or otherwise harmful.

Intellectual Property Claims

MysticsFive will respond to clear and complete notices of alleged copyright or trademark infringement, and/or violation of third party’s terms of service.

Fraud / Unlawful Use

You may not use MysticsFive for any unlawful purposes or to conduct illegal activities.

Multiple Accounts

Buyers and Sellers and all users are limited to one active account. Any additional account set up to circumvent guidelines, promote competitive advantages, or mislead the MysticsFive community will be closed.

Targeted Abuse

Accounts of  Users who engage in targeted abuse or harassment towards other users on MysticsFive will be closed.

Selling Accounts

Users may not buy or sell any MysticsFive account.

General Terms

MysticsFive reserves the right to put any account on hold or permanently disable accounts due to breach of these Terms of Service or due to any illegal or inappropriate use of the Site or services.

Violation of MysticsFive’s Terms of Service may result in your account to be disabled permanently.

Users who have violated our Terms of Service and had their account disabled may contact our Customer Support team for more information surrounding the violation and status of the account.

Users are required to verify their account ownership through Customer Support by providing proof of ownership of that account.

Sellers will be able to withdraw their revenues from disabled accounts after a clearance period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account and subject to MysticsFive’s approval.

MysticsFive may make changes to its Terms of Service from time to time. When these changes are made, MysticsFive will make a new copy of the terms of service available on this page.

You understand and agree that if you use MysticsFive after the date on which the Terms of Service have changed, MysticsFive will treat your use as acceptance of the updated Terms of Service.
